A static inline function "invalid_can_skb(skb)" (or "no_can_skb") would
be handy here:

	if (invalid_can_skb(skb)) {
		kfree_skb(skb);
		dev->stats.tx_dropped++;
		return NETDEV_TX_OK;		
	}
